James cornman and r routley and v macrae have argued that the principle of identity (alias leibniz's law) is inconsistent with certain plausible and widely accepted identity statements; e.G., "the temperature of a gas is identical with the mean kinetic energy of the molecules of the gas." they argue on this ground that the principle of identity should be modified to remove this appearance of inconsistency. The requisite modification however, Removes whatever "metaphysical teeth" the unmodified version might have had. ROSENBAUM The argument of Graheim Parkes's "Imagining Reality in To the Lighthouse" is described by its author as "a railing against the realist position" (p. 35) as he understands it primarily in my article "The Philosophical Reedism ofVirginia Woolf." ' Apart from the question of whemer railing is a useful way of conducting an (...) inquiry into literature and philosophy, Parkes's discussion raises several important issues about these connections. The way diey are raised, however, involves various mistedces and muddles that make a brief reply to his eurticle difficult. To begin with a small reveeding example, Parkes asserts that I miss the irony in Virginia Woolfs use of die letters P, Q, and R to describe Mr. Ramsay's problems of diought (p. 41). Here is what I wrote: "By representing Mr. Ramsay 's thinking as proceeding in die very genered form of conventional logical symbols, Virginia Woolf is wittily extending the standard letters used to symbolize die conditional type of argument, If P men Cf (p. 339, with italics added this time). Parkes's misreading of my text does not inspire confidence when he turns to Virginia Woolfs fiction or G. E. Moore's philosophy. On a more significant issue, Parkes complains that I boggle his mind by saying diat philosophically, Moore influenced Virginia Woolf more man anyone else, whereas Platonic ideas abound in her books (p. 35). Of course they do, but not very much in her epistemology, which was the subject of my eurticle.2 What Peirkes does not mention is that Plato was also a profound influence on Moore's philosophy. One of die reasons Moore's influence on Bloomsbury was so strong is that he reinterpreted Plato for them. In her images and ideas Virginia Woolf was influenced direcdy dirough her reading of Plato etnd also indirectly through the work of Plotinus and Moore. These influences are not easily sepeurated, which is why studies of Platonic emd Neoplatonic influences in her work that ignore Moore's significance are so incomplete. 89 90Philosophy and Literature Peirkes claims mat die evidence of Moore's influence on Virginia Woolf is slight (p. 34), and then he concerns himself with the putative influences of German philosophers for whom mere is no evidence at all. In the fifteen years since I wrote my article, the biographical evidence for Moore's influence has continued to accumulate as Virginia Woolfs letters, memoirs, emd dieiries were published. From her first novel, in which Principia Etnica is quoted emd briefly discussed, down to die recently discovered revised version of her last memoir, in which she reaffirms her deep respect for Moore,3 the indications of Moore's significance for Virginia Woolf ought to convince any disinterested reader. It cannot be dismissed with a sneer about "the voguish fascination of the Bloomsbury Group..." (p. 34), especially from someone proposing to study yet again the depth psychology of her fiction via Nietzsche and Heidegger (P- 44). Nothing I say here, of course, will persuade Parkes of the value of philosophical realism for understanding To the Lighthouse because diat philosophy, as he conceives of it in his article, consists of straw. To tedce just one exeimple, Peirkes appeeurs to believe Moore's epistemology etrgues "diat things and persons are what they are independently of human consciousness" (p. 37). There is no space here to explain philosophical realism again to Parkes, odier than to note that it is not inconsistent with the veirious concerns (to use Peurkes's terminology) about "transpersonal imagination" or "participation in phenomena" that he finds so interesting in the novel. But what about die novel? For readers indifferent to whether Moore or Russell, Nietzsche or Heidegger are to be found in To the Lighthouse, the relevant question is what such philosophical interpretations medce of it. To them I ceui only say, reread the novel and then ask yourselves if an account of it diat says nothing about die value of art and almost nodiing about the value oflove bears much resemblance to your reading experience. Parkes thinks the portrait of Mr. Ramsay is unsympathetic because he is criticized emd mocked... (shrink)

Laland and colleagues have sought to challenge the proximate–ultimate distinction claiming that it imposes a unidirectional model of causation, is limited in its capacity to account for complex biological phenomena, and hinders progress in biology. In this article the core of their argument is critically analyzed. It is claimed that contrary to their claims Laland et al. rely upon the proximate–ultimate distinction to make their points and that their alternative conception of reciprocal causation refers to phenomena that were already accounted (...) for by standard theory. This paper explores the ethical and conceptual implications of the findings from an empirical study (reported elsewhere) of decision-making capacity in anorexia nervosa. In the study, ten female patients aged thirteen to twenty-one years with a diagnosis of anorexia nervosa, and eight sets of parents, took part in semistructured interviews. The purpose of the interviews was to identify aspects of thinking that might be relevant to the issue of competence to refuse treatment. All the patient-participants were also tested using the (...) MacArthur Competence Assessment Tool—Treatment test of competence. This is a formalized, structured, interviewer-administered test of competence, which is a widely accepted clinical tool for determining capacity. The young women also completed five brief, self-administered questionnaires to assess their levels of psychopathology. The issues identified from the interviews are described under two headings: difficulties with thought processing and changes in values. The results suggest that competence to refuse treatment may be compromised in people with anorexia nervosa in ways that are not captured by traditional legal approaches. (shrink)

Gordon's emphasizes that the process of prosecution is crucial to the idea of crime. One who commits a public wrong is properly called to public account for it, and the criminal trial constitutes such a public calling to account. The state is the proper prosecutor of crimes: since a crime is ‘our’ wrong, rather than only the victim's wrong, it is appropriate that we should prosecute it, collectively. The case is not simply V the victim, or P the plaintiff, against (...) D the defendant. It is brought, as the Americans properly have it, by ‘the People’, or by ‘the Commonwealth’, against the defendant. This is a useful way in which to think about crimes and criminalisation. This chapter tries to develop this conception of public wrongs a little further, which also involves complicating it more than a little. It works from a version of liberal communitarianism that rejects the metaphysical version of the individualist's ‘unencumbered self’; but the account sketched here should be compatible with all but the most radically individualist kinds of liberal theory. In response to Lawrence Solum's advocacy of a ‘virtue–centred theory of judging’, I argue that there is indeed important work to be done in identifying and characterising those qualities of character that constitute judicial virtues – those qualities that a person needs if she is to judge well (though I criticise Solum's account of one of the five pairs of judicial vices and virtues that he identifies – avarice and temperance). However, Solum's more ambitious claims – that a judge's vice (...) necessarily corrupts her decisions, and that in at least some contexts we must define a legally correct decision as one that would be reached by a virtuous judge – should be rejected: we can undermine the former by attending to the requirements of due process, and the latter by attending to the ways in which a judge would try to justify her decision. Robert Sharpe examines the humanist conception of music as a language--as expressive and intelligible--which has been a dominant theory in Western culture. He argues against the view that music is expressive by causing certain states in us. Rather, he contends that our beliefs about music are integral to our appreciation of it. Differences in musical taste are then not just irresolvable differences in sensitivity, but the result of variations in circumstance and upbringing, of associations and ideology.

Suetonius quotes at Tiberius 21. 4–7 a number of passages from letters of Augustus to Tiberius showing the high regard in which he professed to hold him, despite his reservations about the darker side of his character, once he had decided to adopt him ‘rei publicae causa’ in a.d 4. They seem to have attracted little critical comment, although Seager connects them with the handling by Tiberius of the Pannonian revolt in a.d. 6–9. suggesting that in view of their fulsome (...) character they were probably written towards the end of this period, when the crisis was past, rather than earlier when Augustus may have been critical of Tiberius’ caution in prosecuting the war. But he does not attempt a more detailed appraisal of the possible dates of the individual letters quoted. Sections 21. 4 and 5 in particular present interesting textual difficulties, mainly arising from the transmission of Greek in a predominantly Latin text: this article discusses these with a view to throwing greater light on the historical significance of the letters. Philosophers and historians of the French Revolution have seen Rousseau's influence as the decisive link between the doctrines of the Enlightenment and the practice of its revolutionary disciples. Professor Leigh here addresses the bibliographical foundations of that question, without which all attempts to settle it in the past have lacked authority. Introducing the most advanced techniques to identify variant and pirate editions of Rousseau's writings, he establishes that there were at least 28 separate imprints and an additional 12 reprints of (...) the Contrat Social in collective editions between 1762 and 1783. Professor Leigh shows also that Rousseau's life and thought excited a fascination and interest in the last years of the Ancien Regime which was nursed by the publishers of his Oeuvres, who sought to satisfy an apparently ceaseless demand by extending their editions, while at the same time attempting to ward off both their creditors and their imitators. In this note I have presented the essentials of a view of how laws are falsified, a view which has been held by some notable philosophers but which is radically opposed to that of Professor Popper. I have not scrupled to ?improve? upon it, so the view of no one philosopher is presented. I try to show that an interesting and convincing account of scientific simplicity is implicit in the theory and I conclude by suggesting how we can bring the (...) argument to bear on the problem of the logical status of laws of nature, showing that through their manner of falsifiability, laws share some characteristics with necessary statements as well as with empirical generalizations. Three arguments are proposed against the idea that ordinary talk about the mind constitutes a folk psychology, a sort of prescientific theory which explains human behaviour and which is ripe for replacement by a neurological or computational theory with better scientific credentials. First, not all talk of the mind is introduced to explain in the way assumed by those who think that mental talk hypothesizes inner processes to explain behaviour. Second, the individuation of the behaviour which is explained by the (...) inner processes itself requires reference to ?mental? states such as intentions or desires. Consequently the project is circular. Finally, scientific theory is a practice with a history which may be matched in the case of ordinary talk of the mind. Certainly ordinary talk of motives, intentions, and thoughts may be infected by the theorizing of economists and sociologists et al., but it is impossible that all talk of the mind should be theoretical in this way. The Model Penal Code’s ‘De Minimis’ provisions (§ 2.12) cover different kinds of case in which, for reasons of equity, a prosecution should be dismissed. An exploration of these different cases illuminates some general issues about the structure of the criminal process, and about the processes of criminalization. These include the significance of the difference between dismissing a case and acquitting the defendant, and of the distinction between offences and defences; whether criminal offences should always be so defined that they (...) specify at least a pro tanto wrong, or may sometimes legitimately specify only a prima facie wrong – and whether this is consistent with the presumption of innocence; what kinds of conduct we can properly be expected to answer for in a criminal court; and the proper division of responsibilities between legislatures, prosecutors and courts in determining what kinds of conduct are to be defined and treated as criminal wrongs. This article draws on scientific explanations of obesity to motivate the creation of a system of paternalistic public health interventions into the obesity epidemic. Libertarian paternalists argue that paternalism is warranted in light of the cognitive limits of human decision-making abilities. There are further, specific biological limits on our capacity to choose and maintain a healthy diet. These biological facts strengthen the general motivation for libertarian paternalism. As a consequence, the creation of a system of paternalistic public health interventions into (...) the obesity epidemic is warranted. (shrink)
